Conservation Commission Minutes 11/13/12
CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
MEETING DATE: November 13, 2012
Present: Richard Andrus, David Dempsey, Christopher Blair and Betty Pixley
The meeting convened at 6:00p.m.

Hume – 73 Chestnut Hill Rd – NOI – seven foot drawdown of Stedman Pond for dam repairs & improvements (B. Pixley is the project manager)
Chris Tryon, representative for Hume stated that they met with DEP and the Army Core of Engineers and the proposal is going to be revised.  The current NOI will be amended and resubmitted.

Town – NOI – RT 23 resurfacing (D. Dempsey is the project manager)
This was continued from last month.  Comments were received from the Natural and reviewed by the Commission.  The project was approved as submitted.

For Discussion:
1.  Chris Tryon was present representing the owners of 258 Main Rd. who have an existing septic system that is failing, breaking out, surfacing and running into the Konkapot River.  The Commission issued an Emergency Certification Form with the following special condition: erosion control mat to be installed as no grass will grow, return in the spring, remove seed & hay.
2.  Mail was reviewed.
3.  Minutes from 9.11 & 10.9.12 were approved as written.
4.  The Commission submitted a level funded budget for FY14 account # 171.
5.  Chris Tryon provided an update on the Main Rd cell tower site.  There are a few more trees they are requesting to cut that are on the cut/no cut line; the Commission will make a site visit tomorrow.  He stated that all of the erosion control measures put in place are working.  The tower has been set as for connecting it to service that is now up to AT&T.
6.  The Commission agreed to send a letter to Commissioner Kimmell at DEP regarding the new procedures for review and processing of NOI’s.  A copy is on file at town hall.
7.  The Commission reviewed the continued research on the unpermitted Beartown Mtn Rd project with regards to the Enforcement Order they will be issuing.
8.  Wayne Burkhart updated the Commission on the recent conference call the Select Board had with Senator Downing, Representative Pignatelli and DCR regarding the mitigation of Lake Buel.
